Copyright Law

Is it Fair Use?

Fair use is a legal concept that allows for the use of a limited amount of copyright-protected material under certain circumstances without getting permission from the copyright owner. Purposes that may allow for fair use of copyright-protected material include: teaching, scholarship, research, criticism, commentary and news reporting.

Factors used to determine fair use are set forth in each country's statute and case law.

Four factors that are used to determine fair use:

  1. The purpose and character of the proposed use

  2. The nature of the work being used

  3. The amount of the work being used

  4. The effect of the use upon the market for the copyrighted work
